1. Overview

These Terms and Conditions ("Terms") govern the use of the website the-ultimate-piano.com and the web application The Ultimate Piano (the "App"). The App is operated by The Ultimate Piano (owner: Kay Talmi), Nimrodstr. 11, 13469 Berlin, Germany. For full operator details, see our Imprint.

By using the App, you agree to these Terms. If you do not agree, please do not use the App.

2. Description of Service

The Ultimate Piano is a browser-based web application for piano learning, practice, and visualization. The App offers:

  • A virtual piano keyboard with MIDI support
  • Music theory tools (scales, chords, progressions)
  • Practice exercises and games
  • A built-in audio/MIDI player
  • Visual customization and screenshot/capture features

The App is provided as a Software-as-a-Service (SaaS) and runs entirely in your web browser. No download or installation is required.

3. Accounts

Some features require a free account. When you create an account:

  • You must provide a valid email address
  • You are responsible for keeping your login credentials secure
  • You may not share your account with others
  • You can delete your account at any time in Settings → License → Delete Account

4. Free and Premium Plans

4.1 Free Plan

The App can be used for free with limited features. The Free plan may be changed or restricted at any time.

4.2 Premium Plan

Premium unlocks additional features. Premium is available as:

  • Monthly Subscription — recurring monthly payment, can be cancelled at any time
  • One-Time Purchase — single payment for permanent Premium access

Current prices are displayed on the pricing page at the-ultimate-piano.com/pricing. We reserve the right to change prices. Price changes do not affect active subscriptions until renewal.

5. Payments and Paddle

All payments are processed by Paddle.com Market Limited ("Paddle"), which acts as our Merchant of Record. This means:

  • Paddle is the seller of record for all purchases
  • Paddle handles payment processing, invoicing, sales tax, and VAT
  • Your payment relationship is with Paddle, not directly with us
  • Paddle's terms apply to all transactions: Paddle Terms of Use

We do not store your credit card or bank details. All payment data is handled by Paddle in accordance with PCI-DSS standards.

6. Subscriptions and Cancellation

6.1 Monthly Subscription

  • Billed monthly on the date of purchase
  • Renews automatically until cancelled
  • You can cancel at any time — access continues until the end of the current billing period
  • Cancellation is available through your Paddle customer portal or in the App under Settings → License

6.2 One-Time Purchase

  • One-time payment, no recurring charges
  • Grants permanent access to Premium features
  • Tied to your account

7. Refunds

Since Paddle is the Merchant of Record, all refunds are handled by Paddle in accordance with Paddle's Refund Policy:

  • You may request a full refund within 14 days of your purchase date — no reason required
  • To request a refund, contact Paddle through the link in your purchase confirmation email, or contact us at [email protected] and we will forward your request
  • Refunds are processed by Paddle to your original payment method

8. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use automated tools (bots, scrapers) to access the App
  • Resell or sublicense access to the App
